This paper investigates the task of reference resolution in the legal domain. This is a new interesting task in Legal Engineering research. The goal is to create a system which can automatically detect references and then extracts their referents. Previous work limits itself to detect and resolve references at the document targets. In this paper, we go a step further in trying to resolve references to sub-document targets. Referents extracted are the smallest fragments of texts in documents, rather than the (...) entire documents that contain the referenced texts. Based on analyzing the characteristics of reference phenomena in legal texts, we propose a four-step framework to deal with the task: mention detection, contextual information extraction, antecedent candidate extraction, and antecedent determination. We also show how machine learning methods can be exploited in each step. The final system achieves 80.06 % in the F1 score for detecting references, 85.61 % accuracy for resolving them, and 67.02 % in the F1 score for the end-to-end setting task on the Japanese National Pension Law corpus. Background: This study examined the cyberbullying experience and coping manners of adolescents in urban Vietnam and explored the mediating effect of different support to the associations between cyberbullying and mental health issues.Methods: A cross-sectional study was performed on 484 students at four secondary schools. Cyberbullying experience, coping strategies, psychological problems, and family, peer, and teacher support were obtained. Structural equation modeling was utilized to determine the mediating effects of different support on associations between cyberbullying and psychological problems.Results: There were 11.6 (...) and 28.3% of students who reported that they experienced and observed at least one cyberbullying act in the last 3 months, respectively. Among the victims, only 48.2% tried to stop the perpetrators. Meanwhile, the majority of observers belonged to the “Intervene” group who tried to report cyberbullying acts or help victims. Family support was found to partially mediate associations between cyberbullying experience and observation with levels of psychological problems among adolescents.Conclusion: The 3-month rate of cyberbullying experience and observation among urban adolescents aged 11–14 was low. However, current coping strategies against cyberbullying were not sufficient. Family support is an important factor that should be considered for designing interventions to mitigating the impacts of cyberbullying on the mental health of adolescents. (shrink)

Legal text retrieval serves as a key component in a wide range of legal text processing tasks such as legal question answering, legal case entailment, and statute law retrieval. The performance of legal text retrieval depends, to a large extent, on the representation of text, both query and legal documents. Based on good representations, a legal text retrieval model can effectively match the query to its relevant documents. Because legal documents often contain long articles and only some parts are relevant (...) to queries, it is quite a challenge for existing models to represent such documents. In this paper, we study the use of attentive neural network-based text representation for statute law document retrieval. We propose a general approach using deep neural networks with attention mechanisms. Based on it, we develop two hierarchical architectures with sparse attention to represent long sentences and articles, and we name them Attentive CNN and Paraformer. The methods are evaluated on datasets of different sizes and characteristics in English, Japanese, and Vietnamese. Experimental results show that: (i) Attentive neural methods substantially outperform non-neural methods in terms of retrieval performance across datasets and languages; (ii) Pretrained transformer-based models achieve better accuracy on small datasets at the cost of high computational complexity while lighter weight Attentive CNN achieves better accuracy on large datasets; and (iii) Our proposed Paraformer outperforms state-of-the-art methods on COLIEE dataset, achieving the highest recall and F2 scores in the top-N retrieval task. The Coronavirus disease pandemic of 2019 is a vast worldwide public health hazard, impacting people of all ages and socioeconomic statuses. Vaccination is one of the most effective methods of controlling a pandemic like COVID-19. This study aims to investigate the relationship between the number of vaccination injections and fear of COVID-19 and test whether beliefs benefit from vaccination COVID-19 mediate the effect of fear of COVID-19 on the number of vaccination injections. A total of 649 Vietnamese adults were enrolled (...) online to finish answering, including scales The Health Belief Model (HBM) and The Fear of COVID-19 (FCV-19S), consisting of 340 (52.4%) males and 309 (47.6%) females. The data were analyzed using variance, regression, and a simple mediation model. The total score of COVID-19 fear wasM= 22.26,SD= 5.49. Vietnamese fear of COVID-19 was at a medium level. Our results suggest that 18- to 20-year-olds are more fearful of COVID-19 than others. People who received the first dosage exhibited a greater fear of COVID-19 than those who received the second dose and were not inoculated. Additionally, the beliefs benefit of vaccination COVID-19 has a role in the relationship between the number of vaccination injections and fear of COVID-19. During the pandemic, adults in Vietnam are more afraid of COVID-19 than during prior outbreaks. Besides, the Vietnamese populace demonstrated a considerable demand for and high acceptability of the COVID-19 vaccine. The current study indicates that psychological counselors and therapists should counsel clients on the value of vaccination and address the fear of COVID-19 as public understanding of the benefits of vaccines increases. To further clarify the effect of this issue on the correlation between fear of COVID-19 and the number of vaccinations, the results of this study indicate that the existing vaccine communication factor for COVID-19 vaccination should be modified to increase confidence in the benefits of immunization. Purpose This study aims to ascertain the impact of data collecting awareness on perceived information security concerns and information-sharing behavior on social networking sites. Design/methodology/approach Based on communication privacy management theory, the study forecasted the relationship between information-sharing behavior and awareness of data collecting purposes, data collection tactics and perceived security risk using structural equation modeling analysis and one-way ANOVA. The sample size of 521 young social media users in Vietnam, ages 18 to 34, was made up of 26.7% men (...) and 73.3% women. When constructing the questionnaire survey method with lone source respondents, the individual’s unique awareness and experiences with using online social networks (OSNs) were taken into account. Findings The results of the investigation demonstrate a significant relationship between information-sharing and awareness of data collecting, perceptions of information security threats and behavior. Social media users have used OSN privacy settings and paid attention to the sharing restriction because they are concerned about data harvesting. Research limitations/implications This study was conducted among young Vietnamese social media users, reflecting specific characteristics prevalent in the Vietnamese environment, and hence may be invalid in other nations’ circumstances. Practical implications Social media platform providers should improve user connectivity by implementing transparent privacy policies that allow users to choose how their data are used; have clear privacy statements and specific policies governing the use of social media users’ data that respect users’ consent to use their data; and thoroughly communicate how they collect and use user data while promptly detecting any potential vulnerabilities within their systems. Case law retrieval is the task of locating truly relevant legal cases given an input query case. Unlike information retrieval for general texts, this task is more complex with two phases (legal case retrieval and legal case entailment) and much harder due to a number of reasons. First, both the query and candidate cases are long documents consisting of several paragraphs. This makes it difficult to model with representation learning that usually has restriction on input length. Second, the concept of (...) relevancy in this domain is defined based on the legal relation that goes beyond the lexical or topical relevance. This is a real challenge because normal text matching will not work. Third, building a large and accurate legal case dataset requires a lot of effort and expertise. This is obviously an obstacle to creating enough data for training deep retrieval models. In this paper, we propose a novel approach called supporting model that can deal with both phases. The underlying idea is the case–case supporting relation and the paragraph–paragraph as well as the decision-paragraph matching strategy. In addition, we propose a method to automatically create a large weak-labeling dataset to overcome the lack of data. The experiments showed that our solution has achieved the state-of-the-art results for both case retrieval and case entailment phases. (shrink)

The article also uses analytical and synthesis methods to highlight the content of benevolence and righteousness in the cultural tradition of the Vietnamese nation today. The Covid-19 pandemic had affected the world in general and Vietnam in particular. So Nguyen Trai’s thought culture is powerfully and effectively prompt in responding to the Covid-19 pandemic in Vietnam and other countries today. In this article, Nguyen Trai’s benevolence and righteousness fairness clearly define the responsibility of the state and the obligation of citizens to promote the traditional cultural values of the nation. Resumo: Nguyen Trai foi um grande filósofo patriótico vietnamita, uma das maiores personalidades de todos os tempos. Ele viveu no século XV; seus pensamentos se tornaram um grande exemplo de ética, cultura, alma e sabedoria vietnamitas. O artigo estudou os pensamentos filosóficos de Nguyen Trai, para ajudar a desenvolver um país próspero e feliz, usando os valores culturais tradicionais da nação. O texto utiliza a metodologia do materialismo dialético como princípio geral e como princípio histórico específico, a fim de avaliar a benevolência e a retidão de Nguyen Trai, em termos de compaixão, justiça e gestão, associadas aos interesses do povo, da comunidade e da sociedade. O artigo também usa métodos analíticos e de síntese, para destacar o conteúdo de benevolência e retidão, na tradição cultural da nação vietnamita hoje. A pandemia de Covid-19 afetou o mundo, em geral, e o Vietnã, em particular. Resumo: Com o fito de compreender as noções de história e juízo político, este artigo pretende mostrar a peculiar interpretação que Hannah Arendt faz da mais conhecida e discutida personalidade filosófica: Sócrates. Assim como outras ideias, tais como a de banalidade do mal, a natureza do terror totalitário e de espaço público, sua estrita pintura do filósofo grego nos demanda a tarefa de discriminar a diferença entre pensamento e ação. Seria acaso o juízo a ponte entre as atividades de pensamento (...) e da ação política? A preocupação, neste ensaio,é a de mostrar como Hannah Arendt estava procurando por um modo autêntico de filosofia política, cujo maior exemplo seria Sócrates. No mesmo sentido, também se debruça acerca do significado do juízo reflexionante, ideia bastante fecunda em sua obra que permanece ainda bastante alusiva.: In order to understand Arendt’s conceptions of history and political judgment, this article discusses her peculiar interpretation of Socrates. As with her other ideas, such as the banality of evil, the nature of totalitarian terror, and the public space, her portrayal of the Greek philosopher demands that we discriminate between thinking and acting. Would judgment by chance be the bridge between the activities of thought and political action? My aim in this essay is to show how Arendt, from beginning of her work, was looking for an authentic mode of political life, the major example of which is Socrates. This is a semantic problem. It's not very important compared to the real-world problems presented by bigotry, racism, discrimination, and worse. It's important only to linguistics and the philosophy of language.

When society grows, more people's knowledge of the world needs to learn so that people can understand themselves and act for the development of society. The article studies the thought of Thomas Aquinas to clarify human nature in social life. The paper uses analytical, synthesis, and argumentative methods to explain human nature with its behaviors and perceptions in (...) social life; Aquinas argued that it is human nature to do the right thing to achieve happiness. However, society is more progressive and liberals, but people always realize their lives have many injustices and difficulties. People want their lives to be happy and good but feel depressed. In this article, in an excellent society, people live according to the law and adjust their behavior according to the regulations of society; each person in the society is also better, from which the society is also humane and reasonable that the basis for building a better society in Vietnam. Once upon a time it was assumed that speaking literally and directly is the norm and that speaking nonliterally or indirectly is the exception. The assumption was that normally what a speaker means can be read off of the meaning of the sentence he utters, and that departures from this, if not uncommon, are at least easily distinguished from normal utterances and explainable along Gricean lines. The departures were thought to be limited to obvious cases like figurative speech and conversational (...) implicature. However, people have come to appreciate that the meaning of a typical sentence, at least one we are at all likely to use, is impoverished, at least relative to what we are likely to mean in uttering it. In other words, what a speaker normally means in uttering a sentence, even without speaking figuratively or obliquely, is an enriched version of what could be predicted from the meaning of the sentence alone. This can be because the sentence expresses a “minimal” (or “skeletal”) proposition or even because it fails to express a complete proposition at all.1 Indeed, it is now a platitude that linguistic meaning generally underdetermines speaker meaning. That is, generally what a speaker means in uttering a sentence, even if the sentence is devoid of ambiguity, vagueness, or indexicality, goes beyond what the sentence means. The question is what to make of this Contextualist Platitude, as I’ll call it. It may be a truism, but does it require a radical revision of the older conception of the relation between what sentences mean and what speakers mean in uttering them? Does it lead to a major modification, or perhaps even outright rejection, of the semantic-pragmatic distinction? I think.. (shrink)

There is a simple view of motivation on which desires are like pain-killers; they come in different strengths, and their strength determines their efficacy. That is, the stronger a desire the greater its motivational force and, when two desires conflict, the stronger one “wins out” over the weaker. This view makes it puzzling how anyone could ever exhibit “strength of will” and act on the weaker desire, even when it is a desire for something more highly valued than what is (...) more strongly desired. When the will, as the agent of reason, enters the fray, an explanation of what a person is motivated enough to do must reckon not only with competing desires and their motivational forces, but also with the will’s capacity to be affected by different ones in ways not proportional to their force. However, this complication sheds little light, for if the will must bestow its stamp of approval on a desire before the desire leads to action, then, it would seem, motivational force should be measured by strength of effect on the will. And if that’s the way to measure motivational force, then, since by that measure one always acts on the desire that affects one’s will most, there is no problem of strength of will after all. But the problem seems real, however inapt the label. (shrink)

Experimental philosophy involves subjecting philosophical methods and judgments to empirical scrutiny. I begin by exploring conceptual, confirmational, and empirical factors that limit the significance of experiment-based and survey-based approaches to the evaluation of philosophical epistemic activities. I then consider specific criticisms of experimental philosophy: its experimental conditions lack ecological validity; it wrongly assumes that philosophers rely on psychologized data; it overlooks the reflective and social elements of philosophical case analysis; it misconstrues the importance of both procedural and evaluative forms of (...) philosophical expertise; it incorrectly views psychological bias as incompatible with reliability; and it generalizes to a global, self-defeating skepticism about case judgment. I explain why these criticisms should be understood as converging and interdependent. I also set out a three-level model of philosophical case judgment that frames the criticisms. (shrink)

Die sich um 1800 neu konstituierende Disziplin der Biologie und die idealistische Naturphilosophie Schellings bemuhen sich in ihrer Frontstellung gegen einen unkritisch und ontologisch verstandenen Mechanismus um eine dem Leben angemessene Beschreibung und Erklarung der Lebensphanomene. Vor diesem Hintergrund wird im ersten Teil der vorliegenden Studie das Werk des Naturforschers Carl Friedrich Kielmeyer im Kontext der zeitgenossischen philosophischen und naturforschenden Diskussionen verortet, bevor im zweiten Teil die Bedeutung von Kielmeyers Phanomenologie des Organischen fur die systematische Ausarbeitung des Schelling'schen Systems der (...) Naturphilosophie aufgezeigt wird. In their animosity towards an uncritical and ontology-based mechanism, both the new discipline of biology, which was becoming established around 1800, and Schellings idealistic natural philosophy strove for a description and explanation of the phenomena of life which were pertinent to life. Against this backdrop, the work of the naturalist Carl Friedrich Kielmeyer is placed in the context of contemporary philosophical and naturalist discussions of the time in the first part of this study before the significance of Kielmeyers phenomenology of the organic for the systematic development of Schellings system of natural philosophy is shown in the second part. Think of linguistification by analogy with personification: attributing linguistic properties to nonlinguistic phenomena. For my purposes, it also includes attributing nonlinguistic properties to linguistic items, i.e., treating nonlinguistic properties as linguistic. Linguistification is widespread. It has reached epidemic proportions. It needs to be eradicated. That’s important because the process of communication is not simply a matter of one person putting a thought into words and another decoding them back into the same thought. Much of what a speaker means cannot be (...) traced to what his words mean or to their possibly context-sensitive semantic contents. Words carry information all right, but that information hardly determines what speakers mean in uttering them. They leave plenty of pragmatic gaps and sometimes even semantic slack. I’ll mention various reasons for that, but the important thing is to recognize how much people exploit extralinguistic information in communicating and to avoid confusing this process with semantic context sensitivity. To appreciate the limitations of semantics, we shouldn’t fall for the fallacy of misplaced information or for the more specific fallacies enumerated below. (shrink)

Theoretical studies suggest that, when determining the workplace safety level, CEOs face a trade-off between ex ante safety-improving expenditures and the expected losses due to ex post injury and illness occurrences. We examine whether firms with higher CEO inside debt holdings have safer workplaces. Using establishment-level employee workplace injury and illness data, we find that CEOs’ inside debt holdings are negatively associated with employee workplace injury and illness cases. This relationship is more pronounced if workers’ compensation premiums are more sensitive (...) to injury claims and for firms with more government business and less pronounced for firms with higher levels of secured debt. We provide some evidence that our main result stems from CEOs increasing safety investments. Our empirical results are shown to be robust under a batch of robustness tests and when considering potential endogeneity problems. Our findings suggest that CEOs with higher levels of inside debt holdings are more sensitive to wealth loss due to employee injury and illness, leading to a safer workplace. (shrink)

Influenced by the Wittgensteinian slogan “Don’t look for the meaning, look for the use,” ordinary language philosophers aimed to defuse various philosophical problems by analyzing key words in terms of what they are used to do or the conditions for appropriately using them. Although Moore, Grice and Searle exposed this error – mixing pragmatics with semantics – it still gets committed, now to a different end. Nowadays the aim is to reckon with the fact that the meanings of a great (...) many sentences underdetermine what we would normally mean in using them – even if the sentence is free of indexicality, ambiguity, and vagueness. This can be so because the sentence expresses a “minimal” proposition or even because it doesn’t fully express any proposition. Many theorists are led to defend “truth-conditional pragmatics” (or linguistic “contextualism”), to find a hidden indexical in every syntactic nook or semantic cranny, or otherwise to pay undue respect to seemingly semantic intuitions and intentions. This work aims to explore the application of deep learning-based artificial intelligence technology in sentencing, to promote the reform and innovation of the judicial system. First, the concept and the principles of sentencing are introduced, and the deep learning model of intelligent robot in trials is proposed. According to related concepts, the issues that need to be solved in artificial intelligence sentencing based on deep learning are introduced. The deep learning model is integrated into the intelligent robot system, to assist (...) in the sentencing of cases. Finally, an example is adopted to illustrate the feasibility of the intelligent robot under deep learning in legal sentencing. The results show that the general final trial periods for cases of traffic accidents, copyright information, trademark infringement, copyright protection, and theft are 1,049, 796, 663, 847, and 201 days, respectively; while the final trial period under artificial intelligence evaluation based on the restricted Boltzmann deep learning model is 458, 387, 376, 438, and 247 days, respectively. The accuracy of trials is above 92%, showing a high application value. It can be observed that expect theft cases, the final trial period for others cases has been effectively reduced. The intelligent robot assistance under the restricted Boltzmann deep learning model can shorten the trial period of cases. The deep learning intelligent robot has a certain auxiliary role in legal sentencing, and this outcome provides a theoretical basis for the research of artificial intelligence technology in legal sentencing. To analyze the influence of the integration of piano art and media on long-term care of the elderly in the aging society, and to improve the living standard and happiness of the elderly, based on educational psychology, several scales of self-compiled personal information, the Ackerson personality inventory, and the memorial university of Newfoundland happiness scale were introduced for statement, and questionnaire method was adopted for information collection. Then, the mechanism of the integration of piano art and media on the happiness (...) of the elderly was summarized. The results showed that there were significant differences in the happiness of the elderly in terms of monthly average income, economic pressure, health status, and living conditions. The happiness of the elderly with a monthly income of more than 5,000 yuan was significantly higher than that of the elderly with a monthly income of <3,000 yuan. The happiness of the elderly with low economic pressure was significantly higher than that of the elderly with high economic pressure. The happiness of the elderly with good living conditions was significantly higher than that of the elderly with ordinary living conditions. The happiness score and positive experience of the elderly with learning over 5 years were significantly higher than those with learning <5 years and the non-piano learning group. The total score of happiness in the piano learning group was significantly positively correlated with positive affection and PE, and negatively correlated with neuroticism and psychosis. It is concluded that the piano art learning process based on educational psychology can improve the subjective well-being of the elderly. In addition, the elderly who have been exposed to piano art for a long time are more active in life. Piano art edification is an important factor affecting the psychological well-being of the elderly. The research has a good guiding significance for improving the happiness of the elderly. (shrink)

Recent challenges to Chomsky's poverty of the stimulus thesis for language acquisition suggest that children's primary data may carry “indirect evidence” about linguistic constructions despite containing no instances of them. Indirect evidence is claimed to suffice for grammar acquisition, without need for innate knowledge. This article reports experiments based on those of Reali and Christiansen (2005), who demonstrated that a simple bigram language model can induce the correct form of auxiliary inversion in certain complex questions. This article investigates the nature (...) of the indirect evidence that supports this learning, and assesses how reliably it is available. Results confirm the original finding for one specific sentence type but show that the model's success is highly circumscribed. It performs poorly on inversion in related constructions in English and Dutch. Because other, more powerful statistical models have so far been shown to succeed only on the same limited subset of cases as the bigram model, it remains to be seen whether stimulus richness can be substantiated more generally. Confusion in terms inspires confusion in concepts. When a relevant distinction is not clearly marked or not marked at all, it is apt to be blurred or even missed altogether in our thinking. This is true in any area of inquiry, pragmatics in particular. No one disputes that there are various ways in which what is communicated in an utterance can go beyond sentence meaning. The problem is to catalog the ways. It is generally recognized that linguistic meaning underdetermines speaker (...) meaning because of the need for disambiguation and reference assignment and because people can speak figuratively or indirectly. But philosophers and linguists are coming to recognize that these are not the only ways. Charting the middle ground between the two will require attending to specific examples, noting their distinctive features, and articulating the relevant concepts. That is what I aim to do here.
